Terms and Conditions

This Platform is intended to provide general information to users regarding programs and initiatives offered by Yayasan Peneraju. By accessing or browsing our Platform, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Yayasan Peneraju relationship with you in relation to this Platform.

Yayasan Peneraju reserves the right to amend and vary the terms and conditions of use and the content of this Platform without prior notification.

Usage of the Platform
1. 1.1. Users shall use the Platform only for lawful purposes and in compliance with all applicable laws and regulations.
Definitions
1. 2.1. “Yayasan Peneraju”, “we”, and “us” refers to Yayasan Peneraju Pendidikan Bumiputera, the owner of this Platform, a company incorporated in Malaysia with its registered business address at Level 15-1, Mercu UEM, Jalan Stesen Sentral 5, Kuala Lumpur Sentral, 50470 Kuala Lumpur.
2. 2.2. “User”, “users”, and “you” refers to the user or viewer of this Platform.
3. 2.3. “Platform" refers to the online website or digital interface provided by Yayasan Peneraju, where Users can access information, apply, and interact with various services and resources. This includes, but not limited to, all associated functionalities, features, and tools available.
Account Registration
1. 3.1. Users are required to provide accurate, complete, and up to date information during the account registration process. Users are solely responsible for maintaining and updating their account credentials.
2. 3.2. Any information provided by users (including Personal Data and Sensitive Personal Data as defined under Personal Data Protection Act 2010) is entirely at the Users’ own risks and responsibilities.
User Responsibilities
1. 4.1. While every reasonable effort is made to ensure that the information contained on this Platform is accurate, complete and up to date, we do not guarantee the completeness, accuracy, reliability, timeliness, performance, completeness or suitability of the information contained herein.
2. 4.2. Any reliance on the information, materials, products, or services provided on this Platform is at the User’s own risk.
3. 4.3. Users shall not use this Platform for any unlawful, illegal, fraudulent, or unauthorized purposes. We reserve the right to investigate and take appropriate legal action against any user engaging in unauthorized activities.
Links to Third Parties
1. 5.1. Through this Platform, users may gain access to external Platforms or resources that does not fall within Yayasan Peneraju’s ownership or control. We do not endorse or guarantee such third-party content and disclaim responsibility and liability for its usage.
Content Protection
1. 6.1. All copyright, trademarks, and intellectual property rights in the content of this Platform are the exclusive property of Yayasan Peneraju or its licensors, and are protected under Malaysian laws.
2. 6.2. Unauthorized reproduction or exploitation of content without written permission is strictly prohibited.
3. 6.3. Users shall not use content from this Platform for data mining, scraping, or unauthorized retrieval purposes.
4. 6.4. Infringement of these rights may result in legal action, including criminal prosecution.
Amendment to Terms
1. 7.1. Yayasan Peneraju reserves the right to amend these terms at its sole discretion. Continued use of the Platform after changes constitutes acceptance of the updated terms.
Governing Law
1. 8.1. These terms shall be governed by and in accordance with the laws of Malaysia.

Introduction
1. 1.1. This Privacy Notice is issued in accordance with the Personal Data Protection Act 2010 (“PDPA”) and explains how Yayasan Peneraju Pendidikan Bumiputera (“Yayasan Peneraju", “we”, “our” or “us”) collects, processes, uses, discloses and stores your personal data.
2. 1.2. We reserve the right to amend this Privacy Notice at any time. Any updates will be published on our website.
Types of Personal Data
1. 2.1. We may collect and process your personal data including but not limited to:
  1. 2.1.1. name;
  2. 2.1.2. identification card (eg NRIC/passport);
  3. 2.1.3. contact details (eg email address, phone number, address);
  4. 2.1.4. financial and banking information;
  5. 2.1.5. academic and professional information;
  6. 2.1.6. information submitted through application forms, correspondence or interactions;
  7. 2.1.7. any other personal data provided by you or obtained from authorised sources.
Sources of Personal Data
1. 3.1. Your personal data may be collected from:
  1. 3.1.1. application forms and registration processes;
  2. 3.1.2. communications with us via emails, calls or meetings;
  3. 3.1.3. documents submitted by you;
  4. 3.1.4. Approved Learning and Training Institutions (ALTIs), Approved Leadership Experience Partners (ALEPs) and any other training providers, industry partners or other programme-related partners;
  5. 3.1.5. employers, guarantors or referees;
  6. 3.1.6. third parties where you have provided consent; or
  7. 3.1.7. publicly available sources where permitted by law.
Purposes of Processing
1. 4.1. Your personal data is processed for purposes including:
  1. 4.1.1. processing and evaluating applications;
  2. 4.1.2. administering programmes, sponsorships or financing schemes;
  3. 4.1.3. communicating with you;
  4. 4.1.4. processing payments and financial transactions;
  5. 4.1.5. internal administration, record keeping and governance;
  6. 4.1.6. security and fraud prevention;
  7. 4.1.7. statistical analysis and reporting;
  8. 4.1.8. protecting or enforcing our rights;
  9. 4.1.9. compliance with legal and regulatory obligations;
  10. 4.1.10. facilitating opportunities for education, funding, sponsorships or career placement, including matching you with potential employers or other scholarship/funding providers; or
  11. 4.1.11. programme-related activities and operations.
Marketing & Promotional Use
1. 5.1. You will only receive marketing communications where you have provided your consent. You may withdraw your consent at any time by contacting us or using the unsubscribe option provided in such communications.
Disclosure of Personal Data
1. 6.1. Your personal data may be disclosed to:
  1. 6.1.1. government agencies, regulatory bodies and statutory authorities;
  2. 6.1.2. Approved Learning and Training Institutions (ALTIs), Approved Leadership Experience Partners (ALEPs) and any other training providers and industry partners engaged by Yayasan Peneraju from time to time in connection with its programmes;
  3. 6.1.3. programme partners and strategic partners;
  4. 6.1.4. financial institutions and funders;
  5. 6.1.5. other scholarship bodies, foundations and funding organisations for the purpose of offering you additional or alternative funding opportunities;
  6. 6.1.6. potential employers, industry partners or recruitment platforms for the purpose of career placement, employment opportunities or talent development initiatives;
  7. 6.1.7. service providers including IT, storage, professional advisors;
  8. 6.1.8. related or affiliated entities;
  9. 6.1.9. any other parties where required by law or necessary for the above purposes.
2. 6.2. Such disclosure may include transfers outside Malaysia where necessary.
Security of Personal Data
1. 7.1. We implement reasonable administrative, technical and organisational measures to safeguard your personal data protect against loss, alteration, misuse, disclosure or unauthorised access.
2. 7.2. However, no system is completely secure and we do not guarantee absolute security.
Retention of Personal Data
1. 8.1. Your personal data will be retained only for as long as necessary to fulfil the purposes stated above or as required by law.
2. 8.2. We may delete or anonymise your data when it is no longer required.
Your Rights
1. 9.1. You have the right to:
  1. 9.1.1. request access to your personal data;
  2. 9.1.2. request correction or update;
  3. 9.1.3. request to limit processing (where applicable); and
  4. 9.1.4. withdraw consent for marketing communications.
2. 9.2. Requests may be subject to legal limitations.

Status List

Status	Description
Pending	The application has been submitted and recorded in the system.
Review	The application is actively being reviewed.
Incomplete	The Letter of Offer (LO) and Education Financing Scheme Agreement (EFSA) have been issued and are currently awaiting applicant to upload the signed copy.
Approved	The application has been approved, and the Letter of Offer (LO) and Education Financing Scheme Agreement (EFSA) are now being prepared.
Signed	The applicant has uploaded the fully signed Letter of Offer (LO) and Education Financing Scheme Agreement (EFSA). The documents are now pending counter-signature and acceptance by YP.
Accepted	Documents are verified and counter-signed. Candidate is now an active YP Talent and can start submitting claim.
Exempted	Talent qualifies for exemption from repayment, either completed courses or cases of incomplete under approved conditions.
LOC	Talent has completed the Financing Scheme course with pending repayment (if applicable).
LOT	The Financing Scheme has been terminated and pending repayment from Talent (if applicable).
Rejected	Application has been rejected.
Deleted	Application has been deleted.
Withdrawn	The Talent has exited the Financing Scheme with zero claim amount received.
